The policy landscape taking shape

Autonomous weapons sit at the center of a decade-old but newly urgent diplomatic effort. States have discussed a binding treaty on lethal autonomous weapons systems (LAWS) inside the UN’s Convention on Certain Conventional Weapons framework since 2014, without reaching consensus on a legal definition, let alone a prohibition — a small number of major military powers have consistently resisted binding limits. In February 2023, the United States took a different, non-binding route, launching the Political Declaration on Responsible Military Use of Artificial Intelligence and Autonomy at a summit in The Hague. It commits endorsing states to keep senior human oversight over high-consequence AI systems, subject them to rigorous testing, and ensure they can be deactivated if they misbehave. Nearly sixty states have since endorsed it, though endorsement carries no enforcement mechanism.

Documented use in real conflicts

The debate is no longer purely theoretical. A March 2021 UN Panel of Experts report on the Libyan civil war described Turkish-made Kargu-2 loitering munitions — capable of operating without a live data link to a human operator — being used to hunt retreating forces, in what is widely regarded as a first documented instance of a lethal autonomous weapon potentially engaging targets without direct human control, though experts still dispute whether the system was operating autonomously or under remote control at that moment. Since then, AI-assisted targeting and drone systems have become a routine feature of the wars in Ukraine and Gaza, mostly in supervised roles — target identification and recommendation rather than fully independent engagement — but the trend toward greater autonomy, driven by jamming-resistant and communications-denied conditions, is clear to most observers.

The escalation-risk argument

The core worry isn’t a single autonomous weapon malfunctioning, though that is a real concern; it’s what military AI does to decision timelines and accountability at the strategic level. Systems that can identify and respond to threats faster than a human chain of command can review them create pressure to delegate more of that chain to machines, which compresses the window for de-escalation in a crisis and can turn an ambiguous or accidental event into a fast-moving exchange before any human has fully assessed it. Autonomy also complicates accountability: when a system misidentifies a target, it becomes genuinely difficult to locate the failure inside the sensor, the training data, the human sign-off, or a design assumption no one revisited under pressure.

Where the debate goes from here
